Terms of Service

These Terms of Service govern your use of Narwhal, operated by Datapad Inc. (“Datapad”, “we”, “us”), a company registered in Delaware, USA. By creating a workspace or using Narwhal, you agree to these terms.

The service

Narwhal provides an AI operations workspace with agents, skills, tables, connectors, and automations. We may add, change, or remove features as the product evolves.

Account access

You are responsible for your account and for keeping your credentials secure. When you request support, you authorize our staff to access your account and content as needed to diagnose and resolve the issue.

Your content and responsibilities

You retain ownership of the content you create in Narwhal and are responsible for its accuracy and legality, and for the actions you direct agents to take on your behalf. You must comply with applicable laws, not impersonate others, and report any security issue you discover. We may remove content that violates these terms.

Acceptable use and license

We grant you a non-exclusive, non-transferable license to use Narwhal for your internal business purposes. You may not reverse engineer the service, resell it, or use it to build a competing product.

Third-party integrations

When you connect external tools, your use of those tools remains subject to their own terms. Narwhal acts on the access you authorize and is not responsible for third-party services or content.

Subscriptions, billing, and refunds

Paid plans are billed in advance through our third-party payment processor, Stripe, whose terms also apply. You can cancel at any time; access continues through the end of the current billing period, and fees already paid are non-refundable. We may change pricing or plan terms with advance notice.

Intellectual property

Datapad retains all rights to the Narwhal platform, technology, and brand. These terms do not transfer any of our intellectual property to you.

Disclaimers and limitation of liability

Narwhal is provided “as is” without warranties of any kind, and we are not responsible for delays or failures caused by the internet or third-party systems. To the maximum extent permitted by law, Datapad is not liable for indirect, incidental, or consequential damages arising from your use of the service.

Indemnification

You agree to defend and indemnify Datapad against claims arising from your content, your use of the service, or your breach of these terms.

Termination

You may stop using Narwhal at any time. We may suspend or terminate access if you violate these terms or to protect the service.

Governing law and changes

These terms are governed by the laws of Massachusetts, USA. We may update these terms from time to time; continued use after changes take effect constitutes acceptance.
